Can Dave protect our human rights against terrorists and murderers? No, Dave’s day-trip to Strasbourg today is a PR exercise to appease the right-wing media and his backbenchers.
He will fail to convince the judges in Strasbourg to take a back step in overruling our judiciary, because our membership of the European Convention on Human Rights – itself an organ of the Council of Europe – is inextricably linked to our membership of the EU which became a legal obligation under the Treaty of Lisbon.
Individuals who deem their rights have been ‘violated’ in one country can bring their case to the European Court of Human Rights as the EU’s highest court, ‘after exhaustion of domestic remedies’.
As a Conservative Parliamentary candidate I was assured that a Conservative government would repeal our membership of the European Convention on Human Rights and introduce a British Bill of Rights to stop the European Court of Justice overruling our judiciary.
Dave is on a hiding to nothing in appealing to Strasbourg to be more tolerant of nation states’ judgements. It is about power. Does he really think that these judges are going to relinquish their power over the UK or any other nation state?
As an example of the court’s attitude and an indication of their supreme belief in their superiority, the court’s top judge, Sir Nicolas Bratza QC, said ‘the criticism relating to interference’ in UK affairs was ‘simply not borne out by the facts …. it is disappointing to hear senior British politicians lending their voices to criticisms more frequently heard in the popular press, often based on a misunderstanding of the court’s role and history.’
We can take back power from this arrogant man by introducing a British Bill of Rights. This keeps our obligations under the Lisbon Treaty but Dave’s Attorney General, Dominic Grieve QC, is opposed to our leaving the European Convention on Human Rights and is prepared to resign over the matter. He is also up against the Lib Dems who, at every opportunity, oppose any reform of the EU, re-patriation of powers and are an additional road-block to reform. Let Grieve resign and call the Lib Dem’s bluff because as a PR man, Dave, you know when to play your hand and it’s now. And we can stay members of your beloved EU.
